Illegally withholding money from me - PLEASE READ!:
This is the selling agent for a home which we attempted to purchase. Troy Frei was the "Buyer and Listing Specialist" for Nathan Cano of Cano Real Estate. I applied for the mortgage loan and received my pre-approval for financing so we entered into a purchase agreement contract. We had a specific clause in the purchase agreement which was a standard financing contingency. This clause stated in plain english stated that "if final financing approval could not be gained from the lender that the earnest money would be returned". Final approval from the lender could not be approved due to my inability to meet the loan all of the loan conditions\contingency's, which in the current lending market is not uncommon. We then immediately notified the selling agent of this information and submitted the appropriate paperwork. As expected, they requested a letter from my lender stating denial, and they would approve the refund of my earnest money.We asked my principle lender write and send a letter stating the above aforementioned denial and expected a full and prompt refund of my earnest money. Troy Frei then notifies us that the seller wants to know all the contingencies which I could not meet in addition to the letter from my mortgage lender. This is personal information I do not have to divulge and illegal for him to request. There were countless other problems with this company during the purchase process, but I am only listing the ones which are illegal and verifiable. I would have loved to purchase this home but it just wasn't possible. Now after going through an emotionally draining and stressful battle trying to obtain financing, Cano Real Estate is blatantly trying to steal my hard earned money. I will now have to take this matter up in small claims court and have a very generous attorney willing to my case pro bono because of how "black and white" the legality of this issue is.If you have also had an issue with Cano Real Estate I urge you to let people know.Thank you for reading
