Not As Scary As I Thought....:
Mr Bayer,

I'm fairly certain you sensed after our initial meeting that the idea of filing bankruptcy was very distasteful and humiliating for me. It was also something I never imagined I would have to do. We have had several contacts since the filing and I hope I have done a good job of telling you how much I have appreciated your patience, your understanding, and your graciousness. Never once did you make me feel as though I was asking a ridiculous question. Never once did you make me feel that having to do this 'unthinkable' thing was a reflection on me personally. For these reasons and more, I thank you very much. While I don't wish bankruptcy on any of my friends or family, should the opportunity present itself, I will recommend you in a heartbeat. Dear Mr. Bayer:

Hope all is well with you and your family.

I write this now because I know you are busy and my experience has taught me there is never a perfect time to do things because life can be too short. I want to first thank you for our initial meeting and making me feel like there was light at the end of the tunnel by dispelling my fear and embarrassment of being ‘bankrupt’. As you know my bankruptcy claim was very complicated given my financial and legal situation, and the extent of the allegations driving a pending civil tort action.

I now want to provide you commentary on my attorney Marcus Tiggs. The following I write having seen many attorneys ‘in action’ over the past three years. As my attorney, and especially when in court, I felt confident his arguments were prepared and that he worked mentally to internalize the facts of my case. He always arrived on time if not sooner than I.

When in consultation, he listened to me first; then advocated a strategy. This was very important, as my adversary worked diligently to paint herself a “victim” in financial submissions and in opposing counsel testimony to capture the emotional high-ground. He anticipated her actions and provided my perspective of events that was noted by the Appeals judge. At the podium, Marcus never had to fumble as to the stage of events of my bankruptcy or with the financial schedules and was able to speak in detail and point out ambiguities of her claim.

In Appeals Court, the three judges clearly had read through the facts of the case and did not have any hesitation to test attorney knowledge of the law, facts of the case, and even attorney opinion. Marcus’ solid preparation for argument before the bench in combination with his demeanor while questioning allowed him to concede where necessary without losing sight of his argumentative path. As such, I believe the judges found Marcus’ credible and trustworthy in his presentation particularly on the extensive discussion on whether or not I acted in “good faith”.

As a client, I am pleased my case was ‘liberated’ in both court appeals so I may sell my former house, pay debtors, and move on. I believe this would not have happened if not for Mr. Tiggs professional focus and talent. On thanking him in person, he commented that he only argued the facts of my case. Even if it were that simple, there is an abundance of clients who’s attorney bungles the facts, is incompetent, or lacks care for the client and the final judgment sweeps them down the river.

Marcus is a first class attorney. His humor and candor in the midst of the stress of the process allowed me to feel optimism for fighting a good fight. Importantly, he always treated my mother well and as an asset in this effort to overcome the challenges. As well, I want to note your staff, particularly Bridgette, always treated me like a human being with respect and familiarity.

Above all, though my case may be very small in comparison to others, my gratitude, I hope you will accept as being equal to none.
