Do not use Fox Lumber:
If you deal with this company be very careful. Fox Lumber does not have any sense of fairness or fair play when you are in a dispute with them, allow me to elaborate;
In 2013 we were solicited by a representative from Fox Lumber, we are a general contracting firm in Point Pleasant NJ and they were targeting firms such as ours to get a piece of the Superstorm Sandy rebuild money. We opened up a charge account with them and started using them for our material supplier on projects, in the beginning everything worked well. In 2014 we recieved a lot of interior trim and doors from Fox for a project in Point Beach, most of which we sent back because the customer decided she wanted a different style door and the trim was also changed by the customer, we had Fox come and pick up the materials, somehow, a large portion of that material was not accounted for when they off loaded thier truck at the yard and it kept showing up on our charge account. We kept trying to get them to correct this and ultimately they never did, I had our vice president working with them on this matter, we closed our charge account in the meantime and advised them we would be cash and carry moving forward. In 2014 we already had Fox scheduled to deliver materials for a new house build in Point Pleasant Boro, we paid for every deliver and actually overpaid by approximately $3000.00 which we advised them to use towards our account once we settled the dispute on the returned items.
On July 6, 2014, we were due a draw on the Point Boro project, my client went to the bank who had the construction mortgage and he was told that Fox Lumber had put a COMMERCIAL CONSTRUCTION lien on his property, (This project was a residental build and the lien was an illegal lien) My client called and advised us of this, I immediately contacted Fox' attorney Frank Whittlesey and met with him, I drove to his office with copies of the bills from Fox Lumber together with copes of cancelled checks which we printed from our bank online to prove that we paid them in full on the Point Boro build and actually overpaid his client. We also advised the attorney that they put a COMMERCIAL LIEN on a residential property which was illegal, the property was in a residential zone, on the canal, all of the properties were residences as well and the zoning was an R1 residential zone, I brought the zoning map as well as pictures of the house we were building which would prove that the structure was actually a residence not a commercial property. We asked that they remove the lien immediately, they said they would discuss with Fox and get back to me within two hours. I left the office, I had to call them later in the day, they didn't have the courtesy to call me back, they advised me that thier client refused to remove the lien.
This in fact was a power play by Fox, they were trying to strong arm us into paying them money they were not entitled to. We refused to pay it based on principal and hired an attorney who after reviewing the file advised Fox to remove the lien immediately, they refused, we had to file an emrgent order to show cause hearing aginst Fox here in Ocean County, this was in August 2014, unfortunately the courts were backed up do to all the litigation with Sandy claims and we finally got into court and the judge ordered the Lien removed.
Fox Lumber and its attorney Frank Whittlesey of the firm Scholl Whittlesey and Gruenberg P.C. harmed my business very badly, unfortunately for us, by the time the lien was removed we had been released from the Point Boro project, from July 2014 through September 2014 we continued to work on the Point Boro project using our own money to fund the work because the home owner refused to pay us and decided they were going to milk this for all it was worth and screw us over as well ( which ultimately happened, they fired us from the job) when we advised them we could no longer continue to work on the house without some financial support from them. We used approximately $60,000.00 of our own money to keep the project going not including our legal fees we had to pay to get the lien removed. Fox lumber and its attorneys tried to hurt my business and succeded somewhat.
If you are a builder that has experienced this type of situation with Fox Lumber please contact me, I am told that what the attorney did was criminal, we tried suing Whittlesey and his firm however because of a suit we had with our client wherein we should have named the firm and Whittlesey as co defendants. Our attorney didn't do that so they were able to get the case dismissed. We are filing a formal complaint with the Hunterdon County Prosecutors office against Fox Lumber, its owner and the law firm and Frank Whittlesey.
Do not use Fox Lumber for materials, they are out to screw over their customers.
