After I got arrested for a second DUI, I thought I was gonna lose my license for sure. I wasn't drunk driving, but after getting one on your record, people aren't likely to believe that I hadn't relapsed. I'm sure that's what the cop thought when he ran my record.
I was driving after a late night at the Gaslamp District with a friend when I drove past a red light. The cop saw me, so of course he pulled me over. I didn't mean to drive past the red light, I just thought I had time before the light would turn red. But it's a Friday night, and cops are on the lookout for drunk drivers at 2 am.
So he takes my license and he asks me where I was going, and where I was driving from. I told him that I just left the Gaslamp District, and that I was just driving my friend back to his house in La Jolla. He then mentioned that I had a DUI on record, and asked me if I had been drinking. I said no, and then he gave me the 3rd degree over the red light. Why was did I run the red light if I was sober? I explained that I misjudged the amount of time it had been yellow, that's all. It was a simple mistake.
My drunk friend then started trying to insist to the cop that he saw me not drinking, and the cop just told him to shut up! My friend, drunk and mad, told the cop to shove it. It went downhill from there, because then he told me and my friend to get out of the car. He made me take a field sobriety test, and then put on the report that I failed!
I was in danger of losing my license, so I knew I needed a really good lawyer who had a lot of experience defending DUI cases. My dad's golfing buddy had been arrested for driving while intoxicated, and David Shapiro was his lawyer. His buddy managed to get the charges dropped, so I thought David was probably the right lawyer for me. My cousin agreed with my choice, because his ex girlfriend had retained David as her lawyer when she got arrested for child abuse, and he was able to clear her name.
He made sure I was prepared and that I knew what my rights were every step of the way. He was able to make the case that I should while I did run the red light, it wasn't because I was drunk. Thanks to David Shapiro, I got to keep my license and I didn't add another black mark on my record.
