Mr. Kipuros/Sinmar Realty were either unaware, or failed to notify:
1) Mr. Kipuros/Sinmar Realty has violated multiple aspects of our contract and Arizona Statute. He has failed to provide a reasonable accounting of almost $6500 of unexplained and unsubstantiated "expenses" despite repeated requests for the same and numerous opportunities for a mutual agreeable resolution. Instead, Mr. Kipuros has ignored all such requests and demands.
2) Mr. Kipuros/Sinmar Realty failed to notify us until 6 days after a damaging water leak was first reported by the Tenant to Mr. Kipuros/Sinmar. Although, at the time, Mr. Kipuros assured us that the delay in his response time resulted in no damage, there were in fact damages to our newly installed hardwood floors. Further, Mr. Kipuros failed to provide any reasonable documentation of expenses incurred associated with the clean-up so we were unable to make a claim on the insurance. Another example of how Mr. Kipuros failed in his obligations as a licensed real estate professional and Realtor that resulted in further financial loss for me and my family.
3) Mr. Kipuros/Sinmar Realty were either unaware, or failed to notify me, that the tenant had multiple unauthorized pets.
4) Mr. Kipuros/Sinmar Realty has failed to provide any documentation of a move-out inspection nor any accounting of deposits returned/retained.
6) Mr. Kipuros/Sinmar Realty has attempted to justify a portion of the unaccounted for funds by claiming expenses that are clearly included within the Contract as part of the monthly management fees.
Although I have requested on numerous occasions for Mr. Kipuros/Sinmar Realty to provide evidence for the unaccounted funds I have received no response. Over the past 7 months I have incrementally increased my efforts to encourage Mr. Kipuros to do the right thing. I started with e-mails, then letters, then allowing him to proof read social media reviews before they were posted, then letters from my attorney, etc. etc. etc. Mr. Kipuros is not interested in complying with the terms of the Contract, Arizona Law, or ethical standards. It appears that he understands that legal, and even regulatory action, is slow, costly, and complicated and is not something that most people are willing to follow through with.
My dispute with Mr. Kipuros/Sinmar Realty is not about less than perfect service, or even bad service. It’s about potential embezzlement, fraud, and/or negligence of a licensed professional. Again, I am not passing judgement, as I don’t have all of the evidence, but the reason I don’t have all the evidence is that despite numerous months of requesting/demanding the evidence that is required by the Arizona Department of Real Estate Mr. Kipuros and Sinmar Realty have failed to provide it.
I have recently filed complaints with the AZ Department of Real Estate, the BBB, and the National Association of Realtors.
